A Year of Discounts and Rewards: Privacy Statement

The YEAR OF DISCOUNTS AND REWARDS Program (the "Program") is a program that is administered by Prize Logic, LLC ("Prize Logic") on behalf of HTC America, Inc. ("HTC"). As the Program administrator and host of the Site, defined below, Prize Logic provides this Privacy Statement (the "Statement") to help you understand how Prize Logic collects and uses the personal information that is collected when you enter the Program at www.yearofrewards.com (the "Site"). This Statement does not apply to information collected in other ways or for other programs administered by Prize Logic and does not apply to other HTC programs or websites (which have separate privacy statements). For example, if Prize Logic collects information about you from other sources, the collection and use of that information will be governed by Prize Logic’s agreement with you or the source. "You" means an individual who accesses or uses the Site. In this Statement, "personal information" means any information about an identifiable individual, as further defined under applicable laws.

By accessing or using the Site or providing information to Prize Logic through the Site, you are accepting the practices described in this Statement.

  1. Personal Information that Prize Logic Collects. When you visit the Site, Prize Logic collects information when you choose to submit it to Prize Logic as well as when you use the Site.
    • Personal Information You Submit. Prize Logic collects personal information when you submit it to the Site. The personal information collected includes your mobile phone number, name, mobile phone type, email address, and account information (obtained through online registration). The Site may be changed from time to time to include other specific personal information. The personal information Prize Logic asks you to provide is required for you to participate the Program. If you do not provide this personal information, your participation in the Program may be limited or prohibited.
    • Automatically Collected Personal Information. Prize Logic collects certain types of personal information automatically when you visit the Site. For example, when your web browser accesses the Site, Prize Logic obtains certain types of personal information, such as your IP address. Prize Logic stores and uses certain limited information from your browser using "cookies" and other similar mechanisms. A "cookie" is a small data file that the Site transfers to your computer for storage to allow Prize Logic’s server to "remember" specific personal information. Except for your IP address, no other personally identifiable information is stored using the "cookie." Prize Logic may use "cookies" and other tracking mechanisms to help support the integrity of registration processes on the Site and to retain changes that you made. You may be able to disable some cookies by modifying your browser preferences. If you disable cookies, you can still use the Site, but certain Site features and functionality may no longer work properly, or at all.
  2. Prize Logic's Use of Personal Information. Prize Logic uses the personal information it collects to operate the Program. Prize Logic may use your personal information to communicate with you by SMS text messaging or email only if you decide to opt into reminder emails and/or SMS text messages for the Program. If you elect to opt in to receive email and/or SMS text message reminders, Prize Logic may send email or text messages to thank you for participating in the Program, reminder emails and reminder SMS text messages and other emails and text messages. Also, Prize Logic may send information on technical service issues and security announcements. Personal information collected through the Site will be stored and processed in the continental United States. Note that if you opt into receiving SMS text messages, you will be charged standard text messaging and data rates per message and you will be responsible for payment of these amounts.
  3. Sharing Personal Information. Except as described in this Statement, Prize Logic will not disclose personal information about you outside of Prize Logic, HTC, and third party service providers without your consent. Prize Logic may disclose the personal information described in Section 1 of this Statement to HTC and the Program’s third party service providers. If HTC requests Prize Logic to disclose the personal information described in Section 1 of this Statement to HTC, Prize Logic will transmit it to HTC using FTP transmission technology, on an FTP site, and the FTP site will be passcode protected. HTC may use the personal information that Prize Logic transmits to it, but will only do so in accordance with HTC’s privacy statement posted on HTC's website and in compliance with HTC’s obligation to maintain the confidentiality and security of your personal information. Any service providers are obligated to maintain confidentiality and security of the personal information and are restricted from using such information other than as authorized by Prize Logic or as otherwise permitted by law. Your personal information is shared with third party service providers so that they may complete transactions or perform services for you and Prize Logic relating to the Program. For example, Prize Logic may contract with third parties to fulfill the discounts and rewards, send emails and text messages. However, Prize Logic will restrict those third parties to using your personal information in connection with the services they provide under the Program. Prize Logic may also disclose personal information to comply with the law and lawful requests or legal process, protect the rights or property of Prize Logic and its customers, and when Prize Logic believes in good faith that the disclosure is necessary to protect the personal safety of Prize Logic, its employees and customers, or the public.
  4. Children under Age 18. Children under the age of 18 are not entitled to participate in the Program. Therefore, for the Program, Prize Logic does not want to collect personal information from children under the age of 18. If you are under 18, do not use the Site and do not provide Prize Logic any information about yourself, including your name, address, telephone number, or email address (directly, or on site bulletin boards, blogs, etc.) on the Site. If Prize Logic discovers personal information from children under age 18, Prize Logic will delete that information.
  5. Email and SMS Preferences. You may opt-out of receiving future emails or SMS text messages from Prize Logic by following the instructions in email or the SMS text message. If you opt-out of receiving future emails and SMS text messages, Prize Logic may still send you service communications such as (but not limited to) support and security updates and product recall information.
  6. Access and Updates to Personal Information You Submit. If you access the Site, you will be able to view only your own individual monthly rewards and their monthly reward history. You may be able to update your personal information through the Site by updating registration information you provide in connection with the Site. You will be required to sign in with your mobile phone number and password. Prize Logic does not maintain all personal information it collects in a form that can be accessed or updated by you. Prize Logic may keep records of changes to your personal information (including deletions).
  7. Security of Personal Information. Prize Logic is committed to protecting the security of your personal information. Prize Logic limits access to users' personal information to a select group of site administrators within Prize Logic who have a need to know such personal information. Prize Logic houses all personal information in a SAS 70 hosting environment. Prize Logic uses secure FTP and SSL protocol when collecting or transferring data from the Site. Prize Logic will communicate to third party service providers with a data feed that only contains the user’s mobile number, first and last name, through Prize Logic's secure environment. When Prize Logic disposes of personal information, Prize Logic uses reasonable procedures to erase or render it unreadable.
  8. Other Applicable Terms. This Statement only governs the collection and use of personal information collected through the Site. This Statement does not modify or alter other agreements you may have, or enter into later, with Prize Logic. You may provide personal information to Prize Logic through other means, such as when you call customer service or send personal information related to promotions or product registrations via postal mail. In such instances, this Statement does not apply to your submission of personal information to Prize Logic via postal mail or any other means than via the Site.
  9. Changes to this Statement. This Statement is effective as of the effective date at the top of this Statement. Prize Logic may periodically update this Statement to reflect changes in its practices or applicable laws or regulations. If Prize Logic updates this Statement, Prize Logic will post the updated version of this Statement and it will change the "effective date" at the top of this Statement. If the updated version of the Statement contains material changes to how Prize Logic collects, uses, or shares your personal information, Prize Logic will post a prominent notice of the updated version on the Site or send you an email. Your continued use of the Site constitutes your binding acceptance of the updated Statement.
